1. Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you and DChoiceCore Technologies Ltd, operating as Nivah Hostels ("Nivah", "we", "us"). By using the Nivah platform at nivah.org and the Nivah mobile app (the "Platform"), you agree to these Terms.

If you do not agree, you must not use the Platform.

2. Eligibility

  • You must be at least 16 years old.
  • You must be a current or prospective student at a recognized Nigerian institution, or an authorized hostel management representative.
  • You must provide accurate and complete information during registration.
  • You are responsible for keeping your account credentials confidential.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide truthful registration information.
  • Verify your email address through our verification process.
  • Not create multiple accounts or share your credentials.
  • Notify us immediately of any unauthorized use of your account.

We may suspend or terminate accounts that violate these Terms.

4. Hostel Bookings

Booking Process

  • Bookings are subject to room availability at the time of confirmation.
  • A booking is confirmed only after successful payment or verification by the hostel administrator.
  • Room assignments are based on the room type and bedspaces allocated per booking type.

Payment Terms

  • Payment must be completed within 48 hours of booking. Unpaid bookings may be cancelled.
  • Accepted methods include bank transfer, card, and USSD.
  • All prices are in Nigerian Naira (₦).
  • Billing cycles (annual, semi-annual, quarterly, monthly) are selected at booking time.

Modifications

Booking changes are subject to availability and may incur additional charges. Contact hostel administration through the Platform.

5. Hostel Rules and Conduct

As a resident, you agree to:

  • Comply with all hostel rules and regulations.
  • Maintain your room and shared facilities in good condition.
  • Report maintenance issues promptly through the Platform.
  • Not disturb other residents or damage hostel property.
  • Not sublease or share your bedspace with unauthorized persons.
  • Comply with visitor registration and visiting hours.

Violations may result in warnings, fines, or termination of tenancy without refund.

6. Maintenance and Facilities

  • We strive to maintain all facilities in good working condition.
  • Maintenance requests are addressed based on priority.
  • Scheduled maintenance may cause temporary service interruptions with advance notice.
  • Damage caused by negligence will be charged to the responsible resident.

7. Inspections

  • Prospective students may book property inspections through the Platform.
  • Inspections may be free or paid, depending on configuration.
  • Failure to attend without prior cancellation may forfeit any fee paid.

8. Intellectual Property

All content on the Platform — including text, graphics, logos, images, and software — is the property of DChoiceCore Technologies Ltd and protected by copyright laws. You may not reproduce or distribute any content without our written consent.

9. Limitation of Liability

To the maximum extent permitted by Nigerian law:

  • The Platform is provided "as is" without warranties of any kind.
  • We do not guarantee uninterrupted or error-free operation.
  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount you paid us in the preceding 12 months.
  • We are not responsible for loss or theft of personal belongings within hostel premises.

10. Dispute Resolution

Disputes shall be resolved as follows:

  1. Informal Resolution: Contact us at support@nivah.org first.
  2. Mediation: If unresolved within 30 days, either party may initiate mediation in Lagos, Nigeria.
  3. Arbitration: If mediation fails, binding arbitration under the Arbitration and Mediation Act of Nigeria.

These Terms are governed by the laws of the Federal Republic of Nigeria.

11. Termination

We may suspend or terminate your access at any time for conduct that violates these Terms. Upon termination:

  • Your right to use the Platform ceases immediately.
  • Outstanding payment obligations remain enforceable.
  • Provisions that should survive termination (liability, disputes, IP) shall survive.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on the Platform. Continued use after changes constitutes acceptance.
